        <![CDATA[<p>Motor vehicle accidents happen every day in Tucson for a number of reasons. Distracted or inattentive drivers, speed, weather and other factors are often to blame. However, as one recent <a href="http://www.gabroylaw.com/Motor-Vehicle-Accidents/Bus-Accidents.shtml">Arizona bus accident</a> illustrates, another contributing factor might be improper maintenance, which can lead to a system failure and cause a crash.</p>
<p>In April, a school bus rear-ended a pickup truck near Phoenix. The pickup then struck a car stopped in front of it. The accident sent six people to the hospital with injuries. While the exact cause of the accident is still being investigated, the Arizona Department of Public Safety stated that the bus' improperly installed new brake system may be at fault.</p>]]>
        <![CDATA[<p><strong>Bus Inspections Required Annually </strong></p>
<p>According to reports, the school bus was carrying 35 students when the brakes failed on an off ramp. A DPS spokesman stated that the new brakes were installed after a March inspection by the Department's Commercial Vehicle Enforcement Bureau. This inspection is required by law and must be done annually.</p>
<p>During the annual inspection, the inspector noticed that the bus's brakes had an air leak and ordered the bus out of use until the brakes were repaired. The repairs were made and the inspector signed off on them. However, according to DPS, the new brakes were put on after this second inspection.</p>
<p>Investigations are ongoing but given the importance of school bus safety, hopefully the matter will be resolved soon and appropriate preventive measures will be taken.</p>
<p>For all drivers, this accident serves as a reminder that proper care and maintenance of vehicles is required to avoid unnecessary and possibly severe accidents due to systems failure.</p>

<p>The new website, <a href="http://bikecolli.info/">http://bikecolli.info</a>, provides useful information for bicycle riders who share the streets with motor vehicles every day. Developed and maintained by an avid local bicyclist, the site analyzes bicycle crash data from 2007 to the present.</p>
<h3>Several Types of Accidents Are More Frequent</h3>
<p>Bicyclists that access this website may find it can help prevent accidents. Riders will find it eye-opening to see that the most common type of crash occurs when a bicyclist approaches an intersection while riding the wrong way, either on the sidewalk or on the left edge of the road, against oncoming traffic. A car then turns right and collides with the bicycle. The motorist is typically looking to the left while turning and is not expecting a bicycle to be approaching from the right. Over a fifth of the recorded crashes are of this type. Cyclists should ride with the flow of traffic and stay off sidewalks to avoid these types of crashes.</p>
<p>Approximately 17 percent of crashes occur when a car going straight through an intersection strikes a bicyclist moving on the cross street. These crashes can result from either the bicyclist or motorist failing to yield the right of way.</p>]]>
        <![CDATA[<h3>When Do Most Accidents Occur?</h3>
<p>Besides describing types of accidents, the website also shows when accidents occur separated by month, day of the week and hour.</p>
<p>Over the course of a year, more crashes take place in the temperate spring and fall months than during summer and winter. Accidents are more common Monday through Friday between the hours of 3:00 p.m. and 6:00 p.m. This corresponds with work commute hours, when both bike and vehicle traffic are at their peak.</p>
<p>Along with staying off sidewalks, the website developer has two other pieces of advice for riders: assume motorists do not see you, and be constantly on the alert.</p>

        <![CDATA[<p>For drivers in the Tucson area, April means that the long talked about texting while driving ban is now in effect. The ban seeks to reduce the number of <a href="http://www.gabroylaw.com/Motor-Vehicle-Accidents/Distracted-Driver-Auto-Accidents.shtml">distracted driver auto accidents</a> within the city.</p>
<p>As of April 1, drivers in Tucson are subject to a fine of $100 or more if caught texting while driving. If it can be shown that a driver was texting and involved in an accident, the fine starts at $250. The new law makes texting while driving a primary offense, meaning a Tucson law enforcement officer can pull a driver over if the driver appears to be texting even if the driver is otherwise violating no laws.</p>
<p>The new ordinance was first discussed on this blog in November, at which time the council decided unanimously to draft a texting ban.</p>
<p>While all motorists are affected, many may welcome the change aimed at increasing safety on Tucson's roads. Only law enforcement officials are exempt from the new law - although only as part of their official duties.</p>]]>
        <![CDATA[<p>Officials admit that it is not always clear whether a person is using their phone to send messages or simply checking the time. In light of this, however, the new ordinance may be more about citizens following the new rule than actual enforcement. The city attorney is confident that most residents of Tucson will comply with the law.</p>
<p>Arizona's largest city, Phoenix, already has an ordinance with similar penalties. The state's major cities have now enacted texting bans, but state legislature has been unwilling put in place a statewide ban. Early in March 2012 the Arizona House defeated a measure including a texting ban by a narrow 31-to-28 margin. Previous bills to prohibit texting while driving have not come to a vote, having been held up in committee.</p>
<p>Opponents of statewide legislation claim that a ban on texting while driving amounts to overregulation. Supporters argue that it is necessary as a safety measure. Nationwide, thirty-five states have enacted such prohibitions.</p>

<p>Punitive damages are damages that may be awarded in certain <a href="http://www.gabroylaw.com/Personal-Injury/">Arizona personal injury</a> and products liability cases. These damage awards are designed to punish a business for extreme or gross negligence or reckless disregard for the safety of others.</p>
<p><a href="http://www.azleg.gov/legtext/50leg/2r/summary/s.1336edjc_caucus-floor.doc.htm">This bill</a> was sponsored by a lobbying organization made up of business interests. The group would like to prohibit juries from awarding punitive damages. While is does not appear that this bill will pass during the current session, it may come up again next year.</p>]]>
        <![CDATA[<p><strong>Current Standard Provides High Bar </strong></p>
<p>In Arizona, the courts have already raised the bar on punitive damages. The Arizona Supreme Court has provided that punitive damages may only be awarded in the "most egregious of cases, where there is reprehensible conduct combined with an evil mind over and above that required for commission of a tort." A tort is basically any legal wrongdoing, such as a store owner negligently failing to repair a dangerous condition at his shop.</p>
<p>The&nbsp; "evil mind" standard must be shown by "clear and convincing" evidence. This is a higher standard than what is necessary to receive actual monetary damages.</p>
<p>Given this standard, it seems unlikely that many businesses are being hit with punitive damages, unless they regularly operate with an "evil mind."</p>
<p>One supporter of the bill claimed the legislation would make Arizona a more competitive state for manufacturers. One has to wonder how? If a business were not an "evil hand guided by an evil mind," then&nbsp;it would not be subject to punitive damages under current law. It seems unlikely there are many businesses that would both comply with state or federal standards and have the necessary "evil mind."</p>

        <![CDATA[<p>In mid-January 2012, a Tucson woman was fatally injured when the SUV she was driving drifted across the center line and struck oncoming traffic and then rolled over. While the exact cause of the accident was not reported, it did occur in the late afternoon, a time when many drivers may feel drowsy after a long day at work.</p>
<p>To help prevent accidents similar to this fatal <a href="http://www.gabroylaw.com/Motor-Vehicle-Accidents/Car-Accidents.shtml">Arizona car accident</a>, automobile manufacturers are beginning to offer technologies that warn drivers when they are drifting in their lane. The technology would fight drowsy driving and keep vehicles tracking safely down the road.</p>]]>
        <![CDATA[<h3>Improvements in Vehicle Safety</h3>
<p>The New York Times reports that as an option in its 2013 model-year vehicles, Ford is offering "lane-keeping technology" that helps vehicles stay in their lanes.</p>
<p>The new feature uses a camera to detect the lane lines and warns the driver when a lane line is approached without the turn signal engaged. When drifting is detected, the technology alerts the driver by vibrating the steering wheel. If the driver does not make an effort to center the vehicle in the lane, the technology is able to use the vehicle's power steering to correct course. Similar technologies are offered by Lexus, Mercedes and Toyota.</p>
<p>Ford is also offering another new option called a "Driver Alert System," which detects signs of drowsy driving like weaving and then warns the driver that he or she may need to stop and rest. A chime and a warning display on the dashboard alert the driver. If the driver continues to show signs of drowsiness, the vehicle will continue to warn the driver.</p>
<p>These new technologies, while just beginning to be used by vehicle manufacturers, could reduce the number of accidents in Arizona and around the country.</p>

        <![CDATA[<p>A 15-year-old female Nogales high school student was recently attacked and bitten by a trained police dog. According to the Santa Cruz County Sherriff's office, the attack happened after someone opened the door to the car the dog was in. The dog's handler and two other officers were inside the high school giving a presentation on gun safety at the time.</p>
<p>After students ran to alert the officers, the handler ran outside to catch the German Shepherd. The dog had stopped attacking once the girl was on the ground. The girl was treated for cuts and scratches on her arms and back.</p>
<p><a href="http://www.gabroylaw.com/Personal-Injury/Dog-Bites.shtml">Tucson dog bite attorneys</a> encourage everyone to keep their distance from unfamiliar dogs. Dog bites can cause serious injury and require painful treatment for rabies and even reconstructive surgery. Organizations like the American Humane Society have programs to help parents teach their children how to behave around dogs.</p>
<p>It is also important to make sure children are supervised whenever a dog is around. Over 80 percent of fatal dog bites in two-year-old children occur because they are not supervised. Children should be taught to talk quietly around dogs so they don't get too excited and never to approach a dog they don't know. If they get permission from a dog's owner to play with the dog, they should hold out their hand and let the dog sniff it first. If the dog likes them, they can scratch the dog under the chin first, not over the head. All of these things will help prevent dog bites.</p>
<p>Learning how to behave around potentially dangerous animals is only one side of the equation. Those who choose to keep dangerous pets within their households must take steps to properly train the animals not to hurt others. Owning a pet carries with it the responsibility for the safety for all who may come into contact with the animal.</p>

        <![CDATA[<p>Like&nbsp;many other insurers, a disability insurer typically has two years from issuance of the policy to rescind it for application misrepresentations or to deny coverage for pre-existing conditions that cause disability. This two-year period is called the "contestable period." <em>See </em>A.R.S. § 20-1346. One case holds, however, that as long as the disability begins within the two years, the statutory bar doesn't apply even if the insurer waits to raise the misrepresentation or pre-existing condition&nbsp;defense until after the two years expires. <em>Russell v. Royal Maccabees Life Ins. Co.</em>, 193 Ariz. 464 (App. 1998). Also, the statute arguably allows rescission at any time for "actual" fraud, as opposed to "legal" fraud, so this can sometimes be an issue.&nbsp; The interplay between these concepts -- rescission, pre-existing conditions, misrepresentation and legal vs. actual fraud -- can be tricky, so it's wise to consult an attorney if you are faced with any of them.</p>

        <![CDATA[<p>Disability polices provide coverage only if the disability actually prevents you from doing your "occupation." So how the policy defines "occupation" is important. There are usually two types: "any occupation" and "own occupation." The former provide benefits if your disability prevents you from doing "any occupation" you are qualified to do by education, training or experience. For instance, a trial attorney that can no longer handle the stress of being in the courtroom may be disabled from being a trial attorney, but she isn't disabled from doing non-trial work, so she wouldn't get "any occupation" benefits.</p>
<p>The second type of policies, on the other hand, provide a benefit if your disability prevents you from doing your "own occupation." Thus, the trial attorney whose disability prevents her from doing trial work would be covered because she could no longer do her "own occupation." As you've probably figured out, "own occupation" coverage is better, and more expensive than "any occupation" coverage.</p>
<p>Some policies include step-down occupation definitions. The first two years of coverage will be for "own occupation" and then the coverage changes to "any occupation" to age 65.</p>
<p>Most policies define the insured's occupation to be what she is doing at the time she becomes disabled. This sometimes becomes an issue when the insured's disability isn't acute but slowly progresses over time, causing the insured to gradually modify her occupation so that it has changed by the time she files a claim. To cope with her disability, our trial attorney might slowly change her practice to doing mostly appellate work so that, by the time she files her claim, her "own occupation" arguably is no longer that of a trial attorney but of an appellate lawyer, which her disability doesn't prevent her from doing, opening the door for the insurer to argue that she's not disabled under her "own occupation" policy. It might have been better for her to have filed her claim when she was mostly doing trial work so that it was clear that was her "own occupation" when she became disabled (and then she might have been able to collect those benefits and still earn a living doing appellate work).</p>
<p>As you might imagine, there is a lot of litigation over what these occupation definitions mean and how to apply them.</p>

        <![CDATA[<p>In Part 1 of this blog, I explained some of the reasons insurance companies love ERISA - the Employment Retirement Income Security Act.&nbsp;&nbsp;Part 2&nbsp;is&nbsp;about&nbsp;what insureds can do about ERISA? The short answer is, not much. But there are a few things that can help.</p>
<p>First, make sure ERISA governs. Often, insurance companies claim ERISA governs when it doesn't. The insurance company bears the burden of proving ERISA governs. Make the company prove it. Maybe the employer didn't really sponsor the life, health or disability benefit as part of its employee benefit plan. Maybe you're dealing with an individual policy, which is less likely than a group policy to be considered part of an ERISA plan. If you ask for proof and the insurance company responds with a settlement offer, then that might be a sign that ERISA doesn't really govern.</p>
<p>Second, get involved as early as possible. This might mean&nbsp;getting an attorney to help&nbsp;file the initial claim. Or, if the initial claim has been denied,&nbsp;having the attorney help with the claim appeal process. (ERISA mandates an appeal process.) The claim file will eventually become the closed "administrative record" and you want to make sure it includes everything you need to support your claim. You will have hard time supplementing that record once litigation is started.</p>
<p>Third, use ERISA. Its statutes and regulations provide numerous opportunities for the insurance company to mess up. And insurance companies do mess up. They miss mandatory notice deadlines. They fail to follow administrative appeal procedures. They draft denial letters that are boilerplate rather than being tailored to the claim at issue.</p>
<p>Fourth, look for "conflicts of interest." The assumption underlying the "abuse of discretion" standard is that the insurance company is acting as a claim "fiduciary" and looking out for the employee's best interest. If you can show that the insurance company had a conflict of interest that impacted how the claim was handled, you can argue the abuse of discretion standard shouldn't apply so that the judge can review the claim "de novo." For similar reasons, you can argue that some limited discovery should be allowed to explore that conflict of interest. (Sometimes the "mess ups" mentioned above are the tell-tale signs of a conflict of interest.)</p>
<p>Finally, if a lawsuit is filed, demand attorneys' fees. ERISA allows the prevailing party to seek attorneys' fees. ERISA is a complicated area of the law and, in my experience, many fee applications by&nbsp;counsel for insureds&nbsp;are granted. That means the insurance company doesn't have to worry just about paying it own fees but yours also.</p>

        <![CDATA[<p>ERISA stands for the Employee Retirement Income Security Act. That is a federal law governing employee welfare benefit plans. Usually, those plans include life, health, and disability benefits; and, usually, those benefits are funded through insurance.</p>
<p>From a claim/litigation standpoint, insurance companies love ERISA because it limits their financial risks and make them more predictable.</p>
<p>First, ERISA preempts state law. That means no state-law claims, like for bad faith or punitive damages.</p>
<p>Second, ERISA's remedies are generally limited to plan benefits, i.e., the underlying benefits at issue (no future benefits, like future disability payments). There is no emotional distress, loss of consortium, or any sort of consequential damages. This allows an insurance company to easily calculate its risk - past benefits, plus interest and attorneys fees. The insurance company doesn't have to worry about the often unpredictable threat "extra-contractual" damages.</p>
<p>Third, ERISA provides federal jurisdiction, so the insurance company always removes ERISA cases to federal court. Insurance companies feel more comfortable in federal court. One reason is because it's usually easier for their lawyers to get admitted pro hac vice in federal court. I know at least one insurance company that used a single law firm to handle almost all of that company's ERISA cases filed in the Ninth Circuit.</p>
<p>Fourth, ERISA changes the "standard of review." In insurance litigation, normally the plaintiff has to prove coverage (e.g., breach of contract, bad faith, etc.) by a preponderance of the evidence. But under ERISA, the insurance policy (usually a group policy called a "plan"), often grants the insurance company (as the "plan administrator") full discretion to decide benefit claims. That means the plaintiff employee has to show that the "plan administrator" abused its discretion in denying benefits. That's a tough standard to meet. The insurance company's decision doesn't have to be the correct one, but one that is merely reasonable - not "arbitrary and capricious."</p>
<p>Fifth, ERISA doesn't permit discovery. Instead, the litigation is basically treated as an "appeal" from an administrative claims process, so the "record on appeal" is limited to the claim file. A corollary to this is that there is no discovery. You can't, for example, depose the claims handler.</p>
<p>Finally, ERISA precludes a jury. ERISA cases are tried to the judge, usually as a "paper trial" through motion practice and submitting the claim file, i.e., the closed "administrative record."</p>
<p>What can the insured do about all this?&nbsp; Not much.&nbsp; But see Part 2 of this blog for some things that can help.</p>

Private disability insurance, as opposed to government sponsored programs like Social Security, can be purchased directly from an insurance company or through an employer's employee welfare benefit plan.&nbsp;</p>
<p>There are two broad categories of&nbsp;disabilty of insurance: short-term vs. long-term. As the name implies, short-term disability (STD) provides benefits for a short time, usually three to nine months. Long-term disability (LTD) provides benefits for a disability that has lasted longer than such short periods, usually referred to as an "elimination period." The length of LTD coverage varies, but most policies provide benefits from after the "elimination period" to age 65 (although coverage may end sooner for certain type of disabilities, e.g., mental-health disabilities). Some people self-insure for the period of short-term disability and purchase insurance only for long-term disability.</p>

        <![CDATA[<p>Saturday, November 19th, riders of all ages, abilities and walks of life rode up to 111 miles of the scenic areas of Tucson as part of the city's University of Arizona Medical Center El Tour festivities, raising over $1.6 million for several charities. The 2011 El Tour marked the 29th annual event organized by Arizona's Perimeter Bicycling Association of America and attracted over 9,000 cyclists.</p>
<p>The cycling event promotes wellness as well as raises awareness of bicycle safety and the prevention of <a href="http://www.gabroylaw.com/Motor-Vehicle-Accidents/Bicycle-Accidents.shtml">Tucson bicycle accidents</a>. Cycling and cyclists present a unique safety challenge on our nation's roadways. On average, two pedal cyclist fatalities occur each day. According to the National Highway Traffic Safety Administration, over 600 pedal cyclists were killed and another 51,000 were injured in 2009. This number represents about 2 percent of all traffic fatalities in the nation that year. The National Safety Council reports that cycling-related injuries and deaths cost the public about $4 billion dollars annually.</p>]]>
        <![CDATA[<p><strong>Tucson Bicycle Safety, Cycling Injuries and Crash Prevention</strong></p>
<p>Since bicycles don't have the same protective framing as motor vehicles, cyclists and their passengers are at risk for more than just simple scrapes and cuts. Broken bones, traumatic brain injury, and even death are all possible risks for cyclists who share the roadways with cars and other larger vehicles.</p>
<p>For cyclists, safety should be the first order of business. The Grand Canyon State has a number of laws that are cyclist-specific. Bicycles must obey the same traffic laws as motor vehicles regarding impairments, distractions, yielding to pedestrians, and maintaining bikes with appropriate brakes and headlights.</p>
<p>Cyclists and their passengers should always wear safety gear, including helmets, in order to prevent serious injury if involved in a <a href="http://www.gabroylaw.com/Motor-Vehicle-Accidents/Bicycle-Accidents.shtml">bike accident</a>. While Arizona does not require helmet use by adults, Tucson requires helmet use by cyclists under the age of 18. Before each ride, cyclists should check their bikes, including brakes and tires. Cyclists should also wear brightly colored clothing, which helps make them more visible to motorists.</p>
<p>In 2008, several El Tour cyclists were injured and one was left in a coma for 40 days after a motorist failed to yield the right of way. Practicing bike safety is just one important way to have safer, more enjoyable rides. Good safety habits are the key to reducing crashes and serious injuries.</p>

<p>According to Karen Uhlich of Ward 3 and Steve Kozachik of Ward 6, who submitted the proposal, 34 states and the District of Columbia ban texting while driving. The council members would like Tucson to join the fight to create safer roads for drivers, bicyclists, motorcyclists and pedestrians and cut down on <a href="http://www.gabroylaw.com/Motor-Vehicle-Accidents/">Tucson motor vehicle accidents</a>.</p>]]>
        <![CDATA[<p><strong>Details of the Proposed Tucson Texting-While-Driving Ban</strong></p>
<p>The proposal would prohibit the use of a personal digital assistant by a person who is driving on a street. Banned use includes sending or receiving a message.</p>
<p>Penalties include a fine of at least $100 if the violator did not cause a <a href="http://www.gabroylaw.com/Motor-Vehicle-Accidents/Car-Accidents.shtml">Tucson car accident</a> and at least $250 if a motor vehicle crash did occur because of texting while driving.</p>
<p>The proposal provides exceptions for commercial driver's license holders on the job, police and emergency workers, public transit drivers, people reporting negligent or reckless behavior and people experiencing an emergency.</p>
<p><strong>Benefits of a Texting-While-Driving Ban</strong></p>
<p>Texting while driving takes the driver's attention from the road, putting everyone in the vicinity at risk. The ban could prevent serious auto accidents, which can cause everything from spinal cord injuries and traumatic brain injuries to amputations and broken bones.</p>
<p>Arizona lawmakers have attempted several times to pass a statewide ban on texting while driving since 2004, but they have not succeeded. In creating its own citywide ban, Tucson could take a significant step toward protecting everyone who shares the road from distracted driving.</p>

        <![CDATA[<p>In the past two months, Tucson streets have been a dangerous place for people on foot, claiming the lives of 6 pedestrians. A total of 13 people have been fatally injured this year while crossing the streets here in Tucson.</p>
<p>A 60-year-old man was the most recent pedestrian death. He was hit when he stepped between two cars and into the street, right into the path of an oncoming car. He died from his injuries a day after the vehicle-pedestrian collision in downtown Tucson.</p>
<p>The investigation revealed that the driver was not at fault for the fatal <a href="http://www.gabroylaw.com/Motor-Vehicle-Accidents/">Tucson motor vehicle accident</a>.</p>]]>
        <![CDATA[<p><strong>Don't Pedestrians Have the Right of Way in Arizona?</strong></p>
<p>Yes, people on foot do have the right of way when crossing a street in a crosswalk. But a pedestrian who does not cross at either a marked or unmarked crosswalk, must yield the right of way to any vehicle on the road.</p>
<p>Right of ways aside, a pedestrian has little to protect him or herself from serious injury if involved in a vehicle-pedestrian accident. That is why it is important for all on foot as well as all behind the wheel to be vigilant about preventing pedestrian accidents.</p>
<p><strong>Stop. Look. Listen.</strong> Before entering or crossing a street, stop at the curb or edge. Look both ways for oncoming traffic, even if you are crossing in a marked crosswalk or a walk sign is displayed on the traffic signal. While crossing the street, continue looking and listening for cars or other signs of danger. Cross the street quickly, getting out of the roadway and back onto the sidewalk, if there is one, out of the path of any oncoming vehicles.</p>
<p>In 2010, 10 pedestrians were fatally injured on Tucson streets. With two months still remaining in 2011, it's everyone's responsibility to take pedestrian safety seriously, keeping an eye out for those on foot, and, for those on foot to keep an eye out for oncoming traffic.</p>
